Please read these Terms carefully. They contain a binding arbitration clause, a waiver of class actions, limits on our liability and a time limit for claims (sections 13, 14 and 22). By using this Site or placing an order you agree to them.

1. Who we are and this agreement

Glimmo (“Glimmo”, “we”, “us”) runs the online store at glimmo.store (the “Site”). These Terms & Conditions, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy (together, the “Terms”), form a legally binding agreement between you and Glimmo. They apply every time you visit the Site, contact us or buy from us.

If you do not agree with any part of these Terms, do not use the Site and do not place an order.

2. Meaning of some words

“Products” means the goods shown on the Site. “Order” means a request by you to buy Products. “Content” means everything on the Site, including text, photos, videos, 360° views, 3D models, graphics, logos and software. “You” means the person using the Site or placing an Order. Headings are for convenience only and do not affect meaning. “Including” means “including without limitation”.

3. Who can buy

You must be at least 18 years old and able to enter into a binding contract, or use the Site with the permission and supervision of a parent or legal guardian who accepts these Terms on your behalf and is responsible for your use.

You confirm that the information you give us (name, email, phone and delivery address) is true, complete and yours to give, and that you are not buying for resale in commercial quantities unless we agree in writing.

4. Products, photos, 360° views and descriptions

We try hard to show Products accurately. However, photos, videos, 360° views, 3D models and descriptions are illustrations only. Colours, finishes, sizes, weights, packaging, accessories and small design details may vary between batches and from what you see on your screen, which depends on your device and settings. Measurements are approximate.

Product descriptions are given in good faith and do not form a warranty that a Product is fit for any particular purpose unless we say so in writing. Products may be made and shipped by independent suppliers on our behalf, and branded or packaging details may differ from the images.

We may change, update or stop selling any Product at any time without notice.

5. Prices, currency and errors

Prices are shown in US dollars (USD) and include the price of the item only. Shipping is shown at checkout before you pay. Depending on our payment setup, your card is charged either in USD or the equivalent amount in Kenyan shillings (KES) at the exchange rate on the day of the Order. Your bank or card provider may apply its own exchange rate or fees, and we are not responsible for those charges or for differences caused by exchange rates.

Import duties, customs fees and local taxes in your country are not included and are your responsibility (see section 8).

Despite our care, a Product may be listed at the wrong price or with wrong details. If we discover an error, we may cancel the Order and refund you in full, or contact you to ask whether you want to continue at the correct price, even after we have sent an order confirmation. We are not required to sell at a price that is obviously wrong.

Prices and promotions can change at any time, but changes do not affect Orders we have already accepted, except for errors as described above.

6. How an order becomes a contract

Placing an Order is an offer by you to buy. A contract is formed only when your payment is successfully confirmed and we have not cancelled the Order. The payment confirmation screen and any automatic message are not a guarantee that we can fulfil your Order.

We may refuse or cancel any Order, or limit quantities, for any lawful reason, including: Product unavailability, pricing or description errors, suspected fraud or unauthorised payment, an address we cannot ship to, export or legal restrictions, or a breach of these Terms. If we cancel after you have paid, we refund the full amount you paid to your original payment method, and that refund is your only remedy for the cancellation.

7. Payment, fraud checks and chargebacks

Payments are processed by our payment providers (currently PayPal). We do not see or store your full card details. You confirm that you are authorised to use the payment method you choose.

We may run fraud and security checks and may ask you for further information before shipping. If we cannot verify an Order, we may cancel and refund it.

If you have a problem with an Order, you agree to contact us first through the Help Center and give us a reasonable chance (at least 14 days) to fix it before you raise a dispute or chargeback with your bank. If you file a chargeback for an Order that was delivered as described, or while a return or refund is already in progress, we will submit evidence to your bank, may suspend future Orders from you, and may recover the amount and any costs we incur as permitted by law.

8. Shipping, delivery, risk and customs

Delivery dates are estimates, not guarantees. Our Shipping Policy explains typical times. Delays caused by suppliers, couriers, customs, weather, holidays or other events outside our reasonable control do not give you a right to cancel or claim compensation, but you can always contact us and we will help.

You are responsible for giving a complete and correct delivery address and for being available to receive the parcel. We are not responsible for parcels delivered to the address you gave, or for failed deliveries caused by a wrong or incomplete address, refusal to accept, or failure to collect. Re-delivery costs in those cases are yours.

Risk of loss or damage passes to you when the Product is delivered to the address you gave (or collected by you). Ownership passes to you once we have received full payment and the Product has been shipped.

International Orders may be subject to import duties, taxes and customs fees charged by your country. These are your responsibility. If you refuse to pay them and the parcel is returned or destroyed, we may deduct the original shipping cost and any return or customs costs from any refund.

9. Returns, refunds and faulty items

Returns and refunds are handled under our Returns & Refunds Policy, which forms part of these Terms. To report a damaged, faulty, wrong or missing item, use the Help Center within 7 days of delivery and include clear photos or video. We may ask for more evidence before deciding.

Where we approve a refund, it is paid to your original payment method. We do not give cash refunds.

10. Cancelling your order

You may ask to cancel an Order before it has been shipped by contacting us in the Help Center with your order number. If the Order has not yet been sent to our supplier or courier, we will cancel it and refund you in full. Once an Order has been shipped it cannot be cancelled, but you may be able to return it under our Returns & Refunds Policy.

11. Using products safely

You must read and follow all instructions, labels and warnings that come with a Product, and use it only for its intended purpose. You use Products at your own risk.

Lamps, projectors, diffusers, fans, chargers and other electrical items: use only with suitable power sources and the supplied cables or equivalent safe ones; keep away from water, heat, flammable materials and children; do not cover, modify or leave running unattended; stop using any item that overheats, smells, sparks or is damaged. Plugs and voltages may differ from your country; you are responsible for using a safe, certified adapter.

Pet products: always supervise your pet, check size and fit, and remove any item that is chewed, damaged or causes discomfort. Our Products are not veterinary products.

Jewellery and accessories: may contain metals or materials that some people react to; stop wearing them if irritation occurs. Small parts are a choking hazard and are not suitable for children under 3. Our Products are not toys unless clearly labelled as toys.

Kitchen items: wash before first use, handle blades and sharp items with care, and check that an item is food-safe, heat-safe or dishwasher-safe for your use before relying on it.

Phone cases, mounts and gadget accessories: check that the model fits your device before use. We are not responsible for damage to your phone or other property from drops, impacts, heat, water or misuse.

12. Warranties

We sell Products “as described” on the Site at the time of your Order. To the fullest extent allowed by law, we give no other warranties or promises, express or implied, including about merchantability, fitness for a particular purpose, durability or non-infringement, and the Site and its Content are provided “as is” and “as available”.

Some laws, including the Consumer Protection Act, 2012 (Kenya) and consumer laws in your country, give you rights that cannot be excluded. Nothing in these Terms removes or limits those rights. Where the law allows us to limit them, our responsibility is limited to, at our choice, repairing or replacing the Product or refunding the price you paid for it.

13. Limits on our liability

To the fullest extent allowed by law: (a) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profit, income, business, data, opportunity or goodwill, however caused; (b) we are not liable for loss or damage caused by misuse of a Product, failure to follow instructions or warnings, modification, accident, normal wear and tear, use with incompatible devices or power supplies, or events outside our reasonable control; and (c) our total liability to you for all claims connected with any Order, Product or the Site is limited to the amount you actually paid us for the Product or Order that the claim relates to.

These limits apply whether the claim is based on contract, negligence, breach of statutory duty or any other legal theory, and even if we were told such loss was possible. They do not limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

14. Your responsibility to us (indemnity)

You agree to defend, indemnify and hold harmless Glimmo, its owners, staff, suppliers and partners from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from: your breach of these Terms; your misuse of a Product or the Site; any false information you give us; any content you send us; or your breach of any law or the rights of any third party.

15. Our content and trademarks

The Site and its Content, including the Glimmo name and logo, are owned by or licensed to Glimmo and are protected by copyright, trademark and other laws. You may view the Site and print pages for your personal, non-commercial use. You may not copy, scrape, reproduce, sell, republish, frame or create works based on any Content without our written permission. Third-party names and marks belong to their owners and their use does not imply endorsement.

16. Messages, reviews and content you send us

When you send us messages, photos, reviews or other content, you confirm that you have the right to do so and that it is accurate, lawful and not offensive. You give us a worldwide, royalty-free, non-exclusive licence to use, store, copy and display it to run our business, handle your request and improve our service. We may publish reviews you submit, with your first name only, and we may refuse or remove any content at our discretion.

17. Things you must not do

You must not: use the Site for anything unlawful or fraudulent; place false or fraudulent Orders or use stolen payment details; impersonate anyone; interfere with, hack, overload or test the security of the Site; use bots, scrapers or automated tools to access the Site; introduce viruses or harmful code; harass our staff; or abuse our returns, refunds, promotions or Help Center. We may suspend or block your access and cancel Orders if you do.

18. Other websites and services

The Site uses and may link to services run by other companies, such as our payment provider, couriers, suppliers and tracking websites. We do not control them and are not responsible for their content, availability, terms or privacy practices. Your use of them is at your own risk and under their terms.

19. Privacy

We handle your personal data as described in our Privacy Policy, in line with the Data Protection Act, 2019 (Kenya) and other laws that apply. By using the Site you acknowledge that Policy.

20. Electronic communications

You agree that we may communicate with you electronically, by email, on the Site or by message, and that agreements, notices and other communications we provide electronically satisfy any legal requirement that they be in writing. Clicking to place an Order is your electronic signature and acceptance of these Terms.

21. Events outside our control

We are not responsible for any failure or delay in performing our obligations caused by events outside our reasonable control, including natural disasters, pandemics, war, unrest, strikes, government action, export or customs restrictions, power, internet or platform outages, cyberattacks, supplier failures and courier delays. Our obligations are suspended while such an event continues, and if it continues for more than 30 days either of us may cancel the affected Order, in which case we will refund any amount paid for Products not delivered.

22. Complaints, arbitration and class action waiver

Talk to us first. If you have a complaint, contact us through the Help Center or by email with your order number and details. You agree to give us at least 30 days to try to resolve it before starting any formal claim. Most problems are solved this way.

Binding arbitration. If we cannot resolve a dispute informally, you and Glimmo agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site, any Product or any Order (including about the existence, validity or scope of this clause) will be finally resolved by confidential arbitration in Nairobi, Kenya, under the Arbitration Act, 1995 (Kenya), by a single arbitrator agreed by both parties or, if we cannot agree within 14 days, appointed by the Nairobi Centre for International Arbitration. The arbitration will be in English and may be held by video or on documents only. The arbitrator’s award is final and binding and may be enforced in any court with jurisdiction.

Small claims. Either of us may instead bring an individual claim in the Small Claims Court of Kenya or an equivalent small claims court, if the claim qualifies.

No class actions. To the fullest extent allowed by law, you and Glimmo each agree to bring claims only in an individual capacity, and not as a claimant or class member in any class, group, collective or representative action or arbitration. The arbitrator may not combine claims of more than one person.

Time limit. To the fullest extent allowed by law, any claim must be started within one (1) year after the event that gave rise to it, or it is permanently barred.

Your local rights. If the law of your country gives you the right to bring a claim in your local courts despite this clause, or makes any part of this section unenforceable for you, the rest of this section still applies to the fullest extent allowed.

23. Governing law

These Terms and any dispute or claim connected with them are governed by the laws of the Republic of Kenya. Subject to section 22, the courts of Kenya have exclusive jurisdiction. If you are a consumer living outside Kenya, you keep the benefit of any mandatory consumer protection rules of your country of residence.

24. General

If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent allowed and the rest will remain in full force. If we do not enforce a right straight away, we have not waived it. You may not transfer your rights under these Terms without our written consent; we may transfer ours to another business, for example if Glimmo is sold or reorganised. These Terms are the entire agreement between you and us about their subject and replace any earlier agreements, statements or understandings. No one else has any rights under these Terms. If there is any conflict between these Terms and anything else on the Site, these Terms prevail unless we say otherwise in writing.

25. Changes to these Terms

We may update these Terms at any time by posting a new version on the Site with a new “Last updated” date. The version in force when you place an Order applies to that Order. Continuing to use the Site after a change means you accept the updated Terms.
